Regulation

Penalized until then by a flat-rate tax of 11.5% on the proceeds of the sale (capital gain or not...), monetary gold had little appeal in France as an investment vehicle.

Indeed, since January 1, 2006, holders of precious metals can choose the tax regime. They can opt for either the Precious Metals Tax (TMP) or the real capital gains tax regime (TPV) as long as they can prove the purchase price.

The TMP rate is 11.5%

The TPV rate is 36.2% on the capital gain since January 1, 2018, with a reduction of 5% per year from the third year of ownership.

Until 12/31/2010, the TPV rate was 28.1%
then 31.3% until 12/31/2011
then 32.5% until 12/31/2013
then 34.5% until as of 12/31/2017.

These new provisions present 3 major advantages for new investors:

• Total exemption after 22 years.

• No tax in the event of capital loss, whatever the duration. (Article 68 of the amending finance law for 2005).

To do this, you must be able to prove the date and purchase value of your gold. In other words, when selling your gold, you will need to present a nominative invoice, dated, with the value of the property.

The two types of investment Gold allow you to benefit from one of the two tax regimes (TMP or TPV) when selling. They are not subject to VAT.
